Harper, is focused on North Carolina <a target=\"_blank\" style=\"font-weight: bold;\" href=\"https:\/\/www.dailymail.co.uk\/news\/republicans\/index.html\" id=\"mol-9a133ff0-f8b3-11ec-9f5a-83769844618d\" rel=\"noopener\">Republican<\/a> lawmakers&#8217; controversial redistricting efforts.\u00a0<\/p>\n<p class=\"mol-para-with-font\">They&#8217;re seeking to reinstate a proposed Congressional map that was thrown out by multiple <a target=\"_blank\" style=\"font-weight: bold;\" href=\"https:\/\/www.dailymail.co.uk\/news\/north-carolina\/index.html\" id=\"mol-9a167440-f8b3-11ec-9f5a-83769844618d\" rel=\"noopener\">North Carolina<\/a> courts for violating state gerrymandering laws.<\/p>\n<p class=\"mol-para-with-font\">But despite that the high court&#8217;s 5-3 conservative majority court said it will take up Moore, which will test the &#8216;Independent State Legislature Doctrine&#8217; &#8211; a theory favored by right-wing legal scholars and Constitutional originalists.<\/p>\n<p class=\"mol-para-with-font\">It&#8217;s an interpretation of the US Constitution where a state&#8217;s legislative branch is free to buck the judicial and executive branches in enacting new election laws.<\/p>\n<p class=\"mol-para-with-font\">In its most extreme form, the doctrine would allow an elected state legislature to operate elections with impunity to their state laws.\u00a0<\/p>\n<p class=\"mol-para-with-font\">More likely, state courts stand to lose the power to override legislatures&#8217; election proposals, according to an interpretation of the doctrine.\u00a0<\/p>\n<p class=\"mol-para-with-font\">Justice Neil Gorsuch, the first appointed by Donald Trump, endorsed the fringe theory as recently as in a concurring opinion for a case about mail-in ballots in the 2020 election.<\/p>\n<p class=\"mol-para-with-font\">&#8216;The Constitution provides that state legislatures &#8211; which could have an effect on the 2024 presidential election outcome.<\/p>\n<p class=\"mol-para-with-font\">Justices have rejected arguments based on the independent state legislature doctrine several times dating from 1916, which upheld the right of Ohio residents to alter election rules by popular referendum.<\/p>\n<p class=\"mol-para-with-font\">The North Carolina Supreme Court struck down Republicans&#8217; proposed map in February.<\/p>\n<p class=\"mol-para-with-font\">Under that plan, Republicans would have been in control of all but three of the state&#8217;s Congressional districts.<\/p>\n<p class=\"mol-para-with-font\">The Tar Heel state&#8217;s highest court voted 4-3 along party lines that the map was &#8216;unconstitutional beyond a reasonable doubt&#8217; in its partisan advantage.<\/p>\n<p class=\"mol-para-with-font\">&#8216;Achieving partisan advantage incommensurate with a political party\u2019s level of statewide voter support is neither a compelling nor a legitimate governmental interest,&#8217; the court ruled.<\/p>\n<p class=\"mol-para-with-font\">Rick Hasen, a law professor at the University of California, told the Associated Press that &#8216;this case could profoundly alter the balance of power in states and prevent state courts and agencies from providing protections for people\u2019s right to vote.&#8217;<\/p>\n<p class=\"mol-para-with-font\">&#8216;There\u2019s a wide range of ways the court could rule on this.
