Shocking footage shows the moment a man hurled racial slurs and threats of murder and rape at his terrified black neighbors at their Oregon apartment complex.

Shirtless Dominic Austin, 19, is seen pounding on the door as he makes the sinister threats, pacing menacingly in front of the mother and daughters’ doorstep.

He even stabs their front door with a knife and in one clip he can be heard saying: ‘I’ll f**king rape your daughter, b**ch.’

‘You’re about to get murdered,’ he says in another, before ominously adding: ‘Call the cops, b**ch.’ He is also heard mumbling angrily about slavery, before asserting that he wants the women to be whipped.

The tenants on the other side, Nubrittany Smith and her elderly, live-in mother Tasha, say they have been subject to such behavior since June and have filed a restraining order against Austin.

However, Austin was only handed an eviction notice this week, before being arrested Wednesday for menacing the women and violating Smith’s August 23 protective order.

In his arrest report, officers with the Gresham Police report wrote how Austin violated the stalking order at least 10 separate times – repeatedly showing up the mother and daughter’s door to harass them while appearing increasingly unstable.

Smith said she reported the threats to police after ‘each event’ – with videos captured on her Ring Security Camera appearing to show Austin’s escalating behavior, which she said took a turn for the worse on September 8.

According to documents obtained by KOIN, that was when Austin was officially notified by management at The Landings at Morrison that he was being thrown out of the complex due to a stipulation in his rental agreement says tenants will be evicted within 24 hours if they should ever threaten another tenant.

The outlet, however, reported that an eviction notice was only handed to Austin on Monday, allowing him roughly two weeks to ramp up his campaign of harassments against the two women, who moved in in June.

The threats began soon after, with the family filing their first formal complaint against Austin on June 30.

Still, no action was taken until this month – and an arrest was not made until Wednesday, hours after KOIN unmasked Austin’s alleged behavior.

Footage posted to social media by Smith further substantiated her and her mothers’ claims – showing Austin issuing death threats to the pair through their locked door.

However, Austin - reportedly the subject of another temporary protective order filed by another neighbor in August - was only handed an eviction notice this week, before being arrested Wednesday for menacing the women and violating Smith's August protective order

He remains shirtless in all of the videos, which were all shared to Instagram by Smith.

In a GoFundMe asking for money to relocate, she alleged that Austin – who at this point was a day from being evicted – was suffering from a mental affliction, and had been coming down to the unit in such a manner since June 29.

‘Every time he comes down he is either holding a knife or beating on [our] door,’ she wrote on September 17, adding ‘the property management is aware of the situation and appears not to be concerned in our health or safety.’

She further revealed: ‘My mother has requested accommodations as far as being transferred to a different unit or paying for to place us in a hotel.

‘The property management declined both accommodations,’ she said.

Within a day after posting the profile – which has raised more than 10,000 in the span of a week – KOIN published its story about the alleged pattern of abuse, and brass at the posh complex near Portland formally hit Austin with an order to vacate.

That notice came nearly two weeks after management hit him with the 24-warning, which they inexplicably did not act on despite Austin’s visits – and the families complaints – persisting to this past Tuesday, when he was handed the order.

‘I was failed by the system and by the Landings at the Morrison,’ Smith told KOIN Wednesday after Austin’s arrest, adding ‘I don’t feel safe because he’s in jail today… I don’t know what tomorrow is going to be’

The next day, only after being named in the KOIN piece, Austin was placed under arrest  – on 10 charges of violating protection orders, and one count of menacing – a felony.

Upon his arrest, it was also revealed that Austin had a stalking protection order filed against him on August 23 by another tenant at the complex.

In that case, cops said Austin continued to violate that order, as well as Smiths’ until Tuesday – the day before his arrest.

Smith has since retained an attorney, alleging staffers at the Gresham apartment complex failed their tenants by allowing Austin’s pattern of abuse to continue unhindered.

‘I was failed by the system and by the Landings at the Morrison,’ Smith told KOIN Wednesday after Austin’s arrest, adding ‘I don’t feel safe because he’s in jail today… I don’t know what tomorrow is going to be.’

She told the station: ‘He could be released at any time. Then what happens next?’

Citing how she reported the behavior to police multiple times, Smith said: ‘As a Black woman, we, I felt that we weren’t heard – I feel that we were not important.’

Her lawyer, citing the landlords’ failure to act on their own policy of booting tenants within a day of making threats against a neighbor, said: ‘The people who run this very large apartment complex didn’t give a damn. The police did not give a damn.’

Claiming that both cops and the complex failed Smith and her mom, he added: ‘I don’t know how anyone can look at those videos and come to any other conclusion.’

Gresham police, meanwhile, sent out a statement in response Wednesday, finally addressing Smith’s complaints.

‘We are aware of the terrible conduct of the suspect in this case, including statements that indicate the motivation for the crime is hate or bias.

‘We share in our communities’ concern and appreciate the unique impact bias crimes, in particular, have on victims.

‘Although the suspect has been arrested and is currently in custody, the investigation is continuing.

‘We are working with the district attorney’s office to ensure the suspect is charged with the appropriate crimes.’

Australian radio host Jase Hawkins has revealed some odd moments he experienced with embattled comedian Russell Brand.

On Monday’s episode of KIIS 101.1’s Jase & Lauren, he detailed his memories when Brand was visiting Australia to promote his film, Get Him To The Greek.

Jase recounted how he was hosting the red carpet chat and afterparty at the time, but the British comedian didn’t turn up.

‘He never rocked up at the after parties. Jonah Hill had to do it… The next day we were working at another radio station 2DAY FM in Sydney and Kyle and [Jackie O] were doing breakfast and he [Brand] rocked up… For the interview.’

Jase then described how Russell engaged with the staff when he got to the studio.

‘He sort of mozzied in and flirted a lot with the girls in the office. My wife was working there at the time. She was in the little kitchenette was making breakfast and popped in and was very, very flirtatious,’ Jase said.

‘He would come in and give them little compliments but in that Russel Brand style. Not handsy.’

The breakfast radio host then told a story about the UK comedian locking himself in the office bathrooms.

According to Jase, Brand was in the bathroom for 20 minutes, posted his bodyguard outside the door to block anyone from going in, and missed his interview on the air.

‘He eventually came out [of the bathroom]. He looked off his dial. This was the point that he said he was off booze and drugs, but it just didn’t not seem legit. I’m not saying guilty or innocent,’ the radio host said.

‘[The women that he flirted with] they laughed it off. That’s what I was saying to Lou [my wife] last night, we were talking about that… Everyone got caught up in this whole Russell Brand thing.’

Two weeks ago, Brand was accused anonymously by multiple women of serious allegations, including rape, sexual assault, and emotional abuse.

The comedian has denied the allegations on his popular YouTube channel, saying his relationships were ‘always consensual.’

The rest of Brand’s ongoing tour in the UK has been delayed, and his sponsors have chosen to distance themselves from him.

Both the BBC and Channel 4 have removed content featuring the comedian from their streaming platforms.

The video platform YouTube has taken action against Brand’s channels, preventing them from earning revenue through advertisements due to a claimed violation of its ‘creator responsibility policy.’

YouTube stated that this suspension of monetisation applies to Brand’s account, which boasts 6.6 million subscribers, and is a result of ‘serious allegations against the creator.’

The Google-owned video service clarified that this decision extends to all channels associated with or run by Russell Brand.

In recent years, Brand has developed a large online following creating videos offering alternative views on media bias, Covid lockdowns, as well as corporate and governmental abuses of power.

Four women have levelled accusations of sexual assault against Brand, spanning from 2006 to 2013, and a fifth individual later came forward with a claim dating back to 2003.

None of Brand’s accusers have so far been publicly identified.

All eyes were on Pippa Middleton at a high-society wedding in Lake Como this weekend, yet it wasn’t her scarlet gown that caught the attention of guests.

Instead, it was Pippa’s clutch bag with the words ‘Eden Rock’ embellished on it – the name of her father-in-law David Matthews’ exclusive Caribbean hotel – that caused a stir.

There have been suggestions that it was with this choice of accessory that Pippa gave a cryptic sign of support for Mr Matthews, 79, who is still being investigated by French police – five years after being charged with raping a 16-year-old girl.

In March, it emerged that French detectives at a Paris unit specialising in protecting minors have launched a new inquiry into allegations relating to Mr Matthews.

This came five years after Mr Matthews, the father of Pippa’s husband James, 48, was arrested by French police in 2018 over allegations he raped a 16-year-old girl on two occasions between 1998 and 1999

Mr Matthews allegedly attacked the 16-year-old girl, who is British but cannot be named for legal reasons, for the first time in Paris and then again on the Caribbean island of St Barts where he owns the £5,000-a-night Eden Rock hotel.

It was during this original inquiry that further allegations are understood to have emerged. Prosecutors confirmed in March that Mr Matthews is under investigation by the same specialist unit – the Brigade for the Protection of Minors – without revealing any further details.

Mr Matthews, a former racing driver, vehemently denies any wrongdoing.

In March, a spokesman for the Paris prosecutors told the Mail on Sunday: ‘The judicial investigation in which David Matthews has been indicted and placed under judicial control is in progress.’

‘I can also confirm a preliminary investigation entrusted to the Brigade for the Protection of Minors is also under way, implicating David Matthews,’ he said, adding he could not provide further details.

Mr Matthews was interviewed by Judge Jean Rea twice in Paris in 2021 regarding the alleged rape of the 16-year-old girl.

He had been first questioned in April 2018 by police after he was arrested as he flew into Paris Orly airport from St Barts where he lives with his wife Jane.

He was held for 48 hours and questioned before appearing at the Palais de Justice, where he was charged with the ‘rape of a minor by a person with authority over his victim’, a crime that carries a maximum 15-year jail sentence in France.

Mr Matthews has previously claimed to his friends that he is being ‘set up’ by the original complainant to ’cause his family embarrassment’.

The alleged rape victim has angrily denied this and told French police in 2017 that she initially blamed herself for the reported attacks, which left her feeling ‘shocked and disgusted’.

Her father later described suggestions that she was trying to humiliate Mr Matthews just months after his financier son James married Prince William’s sister-in-law Pippa, as ‘ridiculous’.

In a 2018 interview with the Mail on Sunday, the woman’s father said: ‘The idea that she is doing this for compensation, or for any other reason than a desire for justice, is completely wrong.’

David Matthews (right with Pippa Middleton in St Barts in February this year), 79, was first arrested by French police in 2018 and remains under investigation over claims he raped a 16-year-old girl on two occasions between 1998 and 1999

David Matthews (right with Pippa Middleton in St Barts in February this year), 79, was first arrested by French police in 2018 and remains under investigation over claims he raped a 16-year-old girl on two occasions between 1998 and 1999

The alleged victim is said to have told French police Mr Matthews had groomed and assaulted her when she had just turned 15 but that the first alleged rape took place when she was 16 – a claim the former racing driver denies.

The statute of limitations for prosecuting rape in France was two decades at the time of Mr Matthews’s arrest, meaning the charges could have been time-barred. A new law in 2018 extended this to 30 years for complainants under 18.

The woman had first told her parents of the alleged rape in 2015, and her account left them ‘incredibly shocked’.

Her father said: ‘She told me, ‘You don’t know what I’ve been going through all these years.’

‘Then it all came pouring out. She said it had been a burden because she had kept it bottled up for so long.

‘It’s caused her an immense emotional strain. She’s been unable to form any lasting relationships.’

Earlier, a source close to the Matthews family said his accuser was being ‘assisted’ in her complaint by her mother.

‘I’ve heard the full story. It’s outrageous,’ said the source. ‘I feel very sorry for David. He’s completely being set up just to cause family embarrassment.’

But the alleged victim’s father said in 2018: ‘My family are furious about what is coming out from the Matthews side since she came forward as she is being made out to be a fantasist and having made it all up.

‘What could possibly be her motivation for revenge or embarrassing the Matthews?

‘We are all behind her and believe her. She had the courage to speak out – and she did, and by doing so she feels she can give herself some sense of closure.’

Mr Matthews attended his son’s 2017 wedding to Pippa with senior members of the Royal Family, including Prince William and Prince Harry.

The son of a Rotherham coal miner, Mr Matthews amassed a £40million fortune by selling a secondhand car business and moving into property development and hotel ownership.

After leaving school, Mr Matthews became an apprentice garage mechanic. At 19 he sold cars door-to-door and, in his spare time, pursued his love of motor racing.

In his younger days he tried his hand at motor racing, and was seen as promising until he was in a serious crash at Silverstone.

It left another driver dead, and Matthews with an eye injury that ended his racing career.

Instead, he concentrated on building his own second-hand car empire, with motor dealerships and interests in luxury coach-making.

His first marriage was to Anita Taylor, one of Britain’s first women racing drivers. They had a daughter, Nina, but divorced three years later in 1969.

He married for a second time to artist Jane Parker and after moving out of their bungalow in Rotherham the couple lived on a 30-acre, 18th Century estate in rural Lincolnshire. As their fortunes rose, there were spells living in Paris, then Monaco.

They had three sons, James, Spencer and Michael – the latter died when he was 22 during an expedition on Mount Everest.

Mr Matthews ventured into hotels, buying up Eden Rock in St Barts in 1995 with his wife Jane.

The five-star Eden Rock hotel, where rooms can cost £5,000 a night, has become a favourite of celebrities and royals including Tom Hanks, Beyonce and Leonardo Di Caprio along with Matthews’s son James and his new wife, Pippa. The rest of the Middleton clan have also been spotted at the resort.

Mr Matthews and Jane now live on the island. He remains on bail, with no travel restrictions, but he has been regularly summoned to Paris for interview.

St Barts is a French island, so part of the European Union. Mr Matthews is not considered a flight risk, or likely to interfere with witnesses, and has co-operated fully with the Paris authorities.

MailOnline has contacted Pippa Middleton and David Matthews’ representatives for comment.

A spokesperson for the family has previously said: ‘David Matthews categorically denies the allegation and unequivocally contests the untrue and scandalous accusation.’

Three men accused of plying a British teenager with alcohol before gang-raping her in a Magaluf hotel are alleged to have called strangers into their room to enjoy ‘free sex’, it has been claimed.

A total of eight men are accused of raping the 18-year-old woman, according to Spanish police, who said the suspects did not know each other prior to the attack on August 14.

Civil Guard investigators discovered one of the men involved in the alleged rape knew the victim by sight and was staying in the same hotel.

He is said to have partnered with two of the other suspects, who saw the woman drunk in a bar in the early hours and decided to buy her even more drinks with the intention of incapacitating her, investigators believe.

Those three are said to have begun the abuse, before inviting strangers in the corridor to follow them into their hotel room for ‘free sex’, according to local media.

The girl fled a hotel room at around 5am, telling police she had woken up surrounded by young people holding mobile phones.

Six suspects – five French and one Swiss – are in jail in Palma, while two more suspects were arrested in France on Sunday and are awaiting extradition.

The spokesman said: ‘The Civil Guard has closed the investigation sparked by the alleged gang rape that took place in a hotel in Magaluf in the early hours of August 14.

‘Officers saw early on the complexity of the investigation, as the alleged aggressors didn’t form part of the same group of friends but, encouraged by other participants, had allegedly joined the group action in sporadic acts, meaning no type of relationship existed between them,’ he said.

A number of men have since been taken into custody by police, with police in France making the latest arrests after Spanish cops discovered the men had flown to Germany before crossing the border en route to the French city of Strasbourg.

The pair arrested on Sunday face extradition to Majorca, while Civil Guard officers announced yesterday their probe to identify the men involved had now concluded.

Confirming the first six suspects had been held the day of the alleged sex attack and remanded in prison, the force said in a statement: ‘The probe continued to identify the two young men whose arrests were pending.

‘Once they had been identified, officers discovered they had taken a flight to Baden-Baden in Germany so they could head to their homes in the Strasbourg area.

‘The Civil Guard sought the assistance of the French authorities through the normal channels and issued European Arrest Warrants to avoid them evading justice.

‘On Sunday, the French police confirmed they arrested one of them in the French locality of Scherwiller before subsequently confirming a second arrest at Basilea Mulhouse Freiburg Airport in France, when that suspect was trying to take a flight to Turkey to avoid detention.’

Officers initially identified three suspects by ringing the girl’s phone, which it was claimed had been stolen during the ordeal.

The man who answered and two of his friends were then duped into heading to the hotel’s reception without realising that they were going to meet police and the girl.

The alleged victim pointed at the men – named as Anthony G, 20, Anthony A, 20, and Khalil A, 18 – and they were quickly arrested.

Two other French men, Thomas E, 23, and Romain C, 26, were reportedly arrested later at the hotel along with the Swiss man Lucas H who is aged 20.

The arrests were made after the victim described the men to police and ‘various surveillance devices’ were placed on the hotel entrances.

All six men were held on suspicion of rape and remanded in custody on Tuesday at a court hearing on the island capital Palma.

Over the weekend, it emerged the judge who refused the six suspects bail and remanded them in prison pending an ongoing criminal probe had concluded the British teenager had suffered ‘really humiliating and degrading treatment’ and described the men’s claims sex was consensual as ‘completely preposterous’.

Mobile phone footage of the alleged sex attack, seized by police on the suspects’ phones and handed over to the investigating judge, is said to have shown the men had been ‘enjoying themselves and laughing.’

On Sunday, Spanish newspaper Ultima Hora published more details of the judge’s remand ruling that it appeared to have been given full or partial access to.

It said the suspects had allegedly ‘deliberately taken advantage’ of their alleged victim’s drunkenness to persuade her to accompany them to a hotel room before ‘surrounding her’ and ‘carrying out numerous sexual practices’ with her despite her ‘obvious lack of awareness and willing to carry out those practices.’

The criminal investigation has now been passed on to Palma’s Court of Instruction Number Two, having been dealt with by a duty court in its initial stages.

The British teenager, who gave a statement to police as well as the investigating judge in court, is said to have flown back to the UK with a female friend who was on holiday with her.

Medical reports revealed that the girl had several bruises or grip marks on her right arm, suggesting she had been held down, and a small cut on her upper chest.

Police have already confirmed they found footage on the suspects’ mobile phones showing the alleged multiple rape that is now in the hands of the investigating judge and could form a ‘key part’ of the case.

BH Mallorca Resort, the hotel where the alleged sex attack took place, has said it is cooperating fully with police and offered its support to the unnamed holidaymaker.

A spokesman said in a statement released last Thursday: ‘The BH Mallorca Resort deeply regrets what has happened and would like to manifest its firm and forceful repudiation of the alleged sexual attack that occurred in the early hours of Monday August 14 at the hotel.

‘The hotel also wants to demonstrate its solidarity with the alleged victim of this aggression.

‘We are co-operating fully with the Civil Guard and its investigators in everything they consider to be necessary.

‘This hotel ratifies through this statement its commitment to the condemnation of all types of sexual attacks that affect peoples’ dignity and physical integrity.

‘Behaviour that undermines those rights has no place in this establishment.’

The hotel said it would be making no further comment for the time being.

A security guard at the hotel reportedly came to the rescue of the 18-year-old Brit after finding her sobbing on the floor in the lobby.

He called police after finding her around 5am on Monday, recalling how he had just come in for his morning shift and describing the police response as very quick and efficient.

Investigators have already looked at CCTV images the hotel has provided and carried out an inspection of the room where the alleged gang rape took place.

The men held and remanded in prison have not yet been charged with any crime as is normal in Spain, where formal charges are only laid shortly before trial.

At this stage they are ‘investigados’ in an ongoing criminal probe, which means they are under formal investigation.

Rape case ‘atrocity’ shocks France: Nation horrified as woman, 29, suffers sickening injuries after being sexually assaulted and tortured with a broomstick by 18-year-old

  • Woman, 29, was raped several times by attacker Oumar N., prosecutors say
  • Oumar broke into victim’s home in Cherbourg where he tortured her with broom

A 29-year-old woman was raped several times – sometimes with a 29 inch long broomstick – and tortured by an 18-year-old man in a sickening case that has sent shockwaves through France

The victim, who remains anonymous, was grabbed by the neck and hit repeatedly in the face and across her body by attacker Oumar N. after he broke into her home in the northwestern city of Cherbourg on August 4, prosecutors say.

The horrified woman was thrown across the room and raped ‘several times’ by the attacker, who also used the broomstick to sexually assault and torture her, reports Le Figaro

The victim was left naked and in a bloodied mess on the floor of her apartment before she managed to reach her telephone and call medics who rushed her to Pasteur Hospital in Cherbourg.

The ‘barbaric’ attack has left the 29-year-old victim with horrific injuries, including a perforated colon, small intestine and diaphragm as well as fractured ribs.

She is still in a coma and is fighting for her life ten days after medics operated on her extensive injuries for several hours.

‘Investigators are shocked, they have never seen so much barbarity,’ a source familiar with the matter told Le Figaro.

Within days of the ‘atrocity’, Oumar N. was arrested after cops matched fingerprints left on a door handle inside the victim’s home to the 18-year-old and geolocated his phone to the house at the time of the attack.

While being questioned by police, sources say Oumar N showed ‘no emotion and no empathy’ for the victim and had initially denied the attack before being shown the fingerprint evidence.

‘He has a dangerous profile, he showed absolutely no emotion and no empathy for the victim,’ a source familiar with the case told Le Figaro. ‘He showed coldness throughout police custody.’

Prosecutors said the sinister attacker, who was known to police for allegedly sexually assaulting his four-year-old sister, was indicted on Saturday for ‘rape accompanied by torture or acts of barbarism’.

The victim told police officers that she had seen Oumar N. in Cherbourg before the attack but did not know him, Pierre-Yves Marot, the public prosecutor of Cherbourg-en-Cotentin, revealed.

The attack she endured and the resulting injuries, which includes the perforation of parts of her abdomen and small intestine, has shocked medics and locals in Cherbourg.

Doctors and nurses who treated the victim when she first came to the hospital were said to be so horrified by her injuries that some broke down and burst into tears. Psychological support is now being provided to the medics, reports France Bleu

French politicians spoke of their outrage at the attack, with some on the far-right blaming an apparent rise of ‘barbarism’ in France for the rape.

Jordan Bardella, president of the National Rally, tweeted: ‘Courage to the 29-year-old victim, umpteenth life shattered by the barbarism that is gaining France.’

French far-right politician Eric Zemmour, who ran to be president earlier this year, wrote on Twitter: ‘I dream of a France where a young woman is not in danger of ending up in a coma after being robbed, raped and horribly tortured by Oumar the repeat offender in her own home.’

Former Bills punter Matt Araiza said he plans to sue attorney Dan Gilleon for defamation in regard to a civil lawsuit filed by the lawyer that alleged the player took part in a gang rape.

Araiza was released by the Bills last August after he was accused of raping a 17-year-old girl along with two of his former San Diego State football teammates near the school’s campus in the fall of 2021.

However, last month, it was concluded by the DA’s office that Araiza was apparently not present during the alleged 2021 gang rape. There is, however, an ongoing civil lawsuit that remains active.

Now, speaking on HBO‘s Real Sports with Bryant Gumbel on Tuesday night, Araiza revealed he has retained an attorney and will not settle the pending civil lawsuit, as he intends to sue Gilleon for defamation.

‘I’ve already hired an attorney for it, and things have already been drafted,’ Araiza told HBO’s Andrea Kremer. ‘I will never waive my right to sue him. That’s coming.’

Gilleon, who was also interviewed on the program, insisted Araiza hadn’t necessarily been absolved of liability when asked about the conclusion by the DA’s office that the player had left the party at the time of the alleged gang rape.

‘We are not saying that he was, and we are not saying that he wasn’t,’ Gilleon said. ‘Let’s say he was not one of the men in there. That doesn’t absolve him of liability.’

The new theory reportedly put forward by Gilleon on the program is that Araiza was ‘part of a scheme among several men to target his client, to get her drunk and to take turns having sex with her over the course of the night.’

However, this theory was not included in the original complaint.

‘Our allegation is, is he contributed heavily to the harm that she suffered that night,’ Gilleon said.

‘He had sex with my client. Following that, she ended up having sex with multiple guys and came out of there bloodied, in shock.

‘Ended up at the hospital, ended up with the police, and ended up traumatized. So that’s what I mean by the gang rape. Gang rapes can occur for two days. They can occur over time. They can occur multiple places. So that’s the clarification.’

Araiza, who said he was in shock when he first read the initial complaint, told HBO he was sure he ‘had never played part in any gang rape.’

He did admit he had sex with the girl but said he believed it to be consensual as he claimed the contact had been initiated by her and that she had ‘made her intentions clear.’

Araiza, who is currently living at home with his parents, did admit that sleeping with the girl only 15-20 minutes after meeting her was ‘stupid’ but insisted it wasn’t deserving of being labeled a ‘gang rapist’ by the media.

He also claimed he was judged in the court of public opinion ‘within seconds’ with no chance to defend himself.

In May, Yahoo Sports reported on a 200-page unsealed document including a transcript of a conversation where a deputy district attorney told the girl, who at the time of the alleged incident was 17, why charges against Araiza were not pursued.

The DA’s office had apparently concluded that Araiza had left the party in San Diego at 12:30am on the night of October 15, 2021 – around an hour before the gang rape is alleged to have happened that Araiza was accused of participating in.

‘He wasn’t even at the party anymore,’ Trisha Amador is quoted as telling the girl by Yahoo. ‘All I know is that at that point, suspect Araiza is gone from the party.’

The report added that there are recordings of the encounter with the girl where the time stamp is 1:30am. Araiza apparently had a witness that helped prosecutors conclude that he had left around an hour earlier.

In February this year, Araiza’s agent denied that he was signing with a Mexican team in a bid to revive his career and said his client hopes for another chance in the NFL.

He was released by the Bills in late August, amid the allegations and mounting public pressure, despite winning the starting job in training camp.

The Ray Guy Award Winner – given to the best punter in college football – was a sixth-round pick in the 2022 NFL Draft and beat out veteran Matt Haack to be the Bills punter.

When the lawsuit became public on August 26, Buffalo initially defended Araiza, before eventually cutting the then-22-year-old two days later.

General manager Brandon Beane said the organization was aware of Araiza’s version of events prior to bringing him to Orchard Park.

New Jersey attorney Matthew Nilo’s first alleged rape victim sat in the courtroom today visibly shaking with anger after his lawyer told a judge his family has raised $500,000 cash of his $5million bail and will be set free.

‘That’s bullsh*t,’ the woman, who wished to go by Lori, told DailyMail.com. ‘He literally hid from cops for 16 years. How is he not a flight risk?’

Nilo, 35, charged with with three counts of aggravated rape, two counts of kidnapping, one count of assault with the intent to rape and one count of indecent assault and battery, has been locked up in a Boston jail.

In an exclusive interview outside the court with DailyMail.com, Lori explained how the alleged rape sixteen years ago destroyed her life, causing her to have a mental breakdown and forcing her onto disability.

Now 39, she thought her assailant would never get caught until cops recently showed up to her home with news of his imminent arrest.

Matthew Nilo's alleged victim Lori spoke to DailyMail.com outside of a Boston courtroom this morning. 'He's a very evil person and he used weapons and force to violently kidnap and rape multiple women,' she said

‘The cops came to my house and said they had identified him and they said that he was identified by DNA – and I was just relieved,’ she exclusively told DailyMail.com. ‘I was in disbelief and awe because I didn’t think he was going to get caught. I’ve been waiting for years for him to get arrested.’

She turned up for his bail hearing Monday, but had no chance to confront him because he didn’t have to appear in court.

‘I had to show it’s not forgotten about, and I’m not going to just let this go,’ she said. ‘And I’m going to continue to speak my mind and make him aware that this is not his city anymore. Boston belongs to us now.’

‘He’s a very evil person and he used weapons and force to violently kidnap and rape multiple women,’ she continued. ‘I can’t get into the details of my case, but I was his first victim, and the charges that are brought against him for me are aggravated rape and kidnapping.

She was 23 at the time of the attack, which she said occurred at gunpoint.

‘I can’t say the details of the case, but he was evil,’ she continued. ‘I’ve dealt with it every day. He’s literally taken 15 years of my life away from me. I’ve lived in fear every day of my life since.’

‘And I don’t know how they can let him back into the world,’ she said of him being allowed to post bail.

‘I think it’s crazy. But that’s the law in Massachusetts, I guess. I think he’s just trying to make a joke of the courtroom, coming up with his bail. I don’t think he cares at all. I don’t think he has any remorse. I think he thought he could get away with this forever. And honestly, I thought he might.’

She said Nilo was a stranger to her when he confronted her on the street, allegedly kidnapped and raped her.

‘I’m out of work and I’ve been on disability for post-traumatic stress,’ she said. ‘I’ve had to deal with flashbacks, just like replaying what happened in my head, what I could have done differently. How come I couldn’t get away fast enough. Like so many things that I wish happened that didn’t.

‘You’ll know by the end of the trial, when the details come out, just how horrific this man acted,’ she said.

‘And the reason I’m so upset that he’s even walking the streets is that I don’t fear just for myself but any female that he’s even close to that doesn’t even know who he is.’

Lori was astonished to learn that Nilo was recently engaged and that his fiancée showed up to his arraignment last week.

‘He has everybody fooled that he is just some smart, regular guy, but he’s not,’ she said. ‘He’s a serial rapist, and not once, twice, three times, but four times in Massachusetts. And he’s done damage to my soul that is irreversible.’

She said she has no doubt that Milo is the one who raped her.

‘I recognized him from all the pictures and especially some pictures online that show him from the time (of the crimes),’ she said.

Nilo will leave the jail with a GPS ankle monitor and will surrender his passport.  He has been ordered to have no contact with victims and witnesses and to stay at least 1,000 feet away from scene of the crimes, Terminal Street in Charlestown.

At the time of the alleged rapes, Boston Police Department issued a warning that a man was attacking women after offering them rides home.

Nilo was identified to law enforcement through family members who voluntarily sent DNA samples to a genealogy database, like ’23 and Me.’

According to a police affidavit, a dozen FBI agents and Boston Police officers arrested Nilo at his luxury apartment complex.

They lured him down to the lobby under the pretense that ‘a large package had been delivered to him that did not fit in the … lockers where the residents pick up packages.’

He was with his fiancée at the time of his arrest, and immediately invoked his Miranda rights.

Nilo is accused of assaulting the four women in or around Terminal Street in Charleston on August 18, 2007, November 22, 2007, August 5, 2008 and December 23, 2008.

Police revisited the investigation last year, using 'forensic investigative genetic genealogy' which resulted in Nilo being placed under surveillance in New York

A 23-year-old woman claims that she was approached by a man in his 20’s after leaving a friend’s home in the State Street area in the early hours.

She said she thought she knew the man, who offered her a ride to help her look for her vehicle before driving her to Terminal Street.

Nilo then allegedly told her to ‘shut up’ or he would kill her, claiming to have a weapon before raping her on a grassy area near railroad tracks, according to court filings.

The second attack took place in November 2007, when a woman, 23, was leaving a bar on State Street after attending a high school reunion.

Documents say that she got into Nilo’s car, thinking it was a taxi, before giving him the address of an ATM near her apartment.

She claims that the man flashed a knife at her after she told him he missed the address, driving her to Terminal Street where he ordered her out of the car before raping her.

The third assault took place in August 2008, after Nilo allegedly approached a 36-year-old woman on Boston Common, promising her money if she went to Charlestown with him.

When they exited the car at Terminal Street, he allegedly ‘tackled her to the ground, held a gun to her back’ and raped her repeatedly.

Prosecutors said that all three women underwent a sexual assault examination, which yielded a DNA profile, which matched the male in each attack.

The final assault took place in December 2008, where a 44-year-old woman was attacked as she was jogging in the area of Terminal Street.

Court documents claim that he approached her from behind, tackled her to the ground and sexually assaulted her.

The man, who was later allegedly identified as Nilo, repeatedly told her ‘I have a gun’ before she managed to escape by poking at his eyes while wearing a glove.

Police revisited the investigation last year, using ‘forensic investigative genetic genealogy’ which resulted in Nilo being placed under surveillance in New York.

The filing, obtained by the Boston Globe, said: ‘FBI agents were able to obtain various utensils and drinking glasses they watched the defendant use at a corporate event.

‘From one of the glasses the Boston Police Crime Lab obtained a male DNA profile, which was found to match the suspect profile from the three Terminal Street rapes.’

The glove that the fourth woman used to poke her attacker with was also tested, with investigators ‘determining that this profile was 314 times more likely to belong to Matthew Nilo than to any other male in the population.’

Boston Police Department has arrested six people, including Nilo, accused of years-old rapes using a $2.5 million federal grant to re-examine ‘unsolved cases that present the greatest threat to public safety.’

Nilo’s lawyer Joseph Cataldo claimed that he has received ‘no indication’ that a search warrant was obtained before they collected Nilo’s DNA samples.

Speaking outside court, he said: ‘My educated guess is there are no search warrants. Obtaining DNA and analyzing it without a warrant based on probable cause, I posit that is unconstitutional.’

Nilo grew up in Boston and attended Boston Latin School, before graduating in 2010 from the University of Wisconsin Madison where he studied psychology.

He earned a law degree at the University of San Francisco in 2015, according to his LinkedIn profile and records posted to the New York State Unified Court System website.

At the time of his arrest, Nilo was working as cyber claims counsel for Cowbell Cyber, and previously worked as a paralegal at the Law offices of Iannella and Mummolo for the two years between his bachelor’s degree and when he started law school.

He was then an associate at the San Francisco-based Clyde & Co and then an associate at Atheria Law in New York.

Cowbell Cyber suspended Nilo when they learned of the charges, saying in a statementL ‘Matthew Nilo was an employee of Cowbell and was hired in January, 2023 after passing our background check. Mr. Nilo’s employment at Cowbell has been suspended pending further investigation.’

Nilo has also lived in Wisconsin and New York and authorities urged anyone who thinks they may have been victimized by Nilo to contact Boston police or the FBI.

Genetic Genealogy used by law enforcement

Genetic genealogy, or ancestry testing, which is the practice of entering a DNA profile into a public database to find relatives, has emerged as a powerful tool for identifying suspects who leave DNA behind at a crime scene.

Investigators can use it to construct a family tree that leads them to an otherwise unknown suspect.

The practice is the use of DNA testing to determine relationships between individuals, find genetic matches and discover one’s ancestry.

Forensic genealogy is law enforcement’s use of DNA analysis combined with traditional genealogy research to generate investigative leads for unsolved violent crimes. Forensic genetic genealogical DNA analysis (‘FGG’) differs from STR DNA typing in both the type of technology employed and the nature of the databases utilized.

The tests employed by investigative teams allow scientists to identify shared blocks of DNA between a forensic sample and the sample donor’s potential relatives.

Recombination or reshuffling of the genome is expected as DNA from each generation is passed down, resulting in larger shared blocks of identical DNA between closer relatives and shorter blocks between more distant relatives.

Departments that employ the use of FGGS, must do so in a manner consistent with the requirements and protections of the Constitution and other legal authorities.

Moreover, investigative teams must handle information and data derived from FGGS in accordance with applicable laws, regulations, policies, and procedures.

When using new technologies like FGGS, the departments must be committed to developing practices that protect reasonable interests in privacy, while allowing law enforcement to make effective use of FGGS to help identify violent criminals, exonerate innocent suspects, and ensure the fair and impartial administration of justice to all Americans.

Actor Danny Masterson has been found guilty of drugging and raping two women at the end of his second trial, after a jury was left impossibly deadlocked in December.

The 47-year-old Scientologist looked stunned as jurors delivered their unanimous verdicts on two of the three charges, and he was handcuffed and taken to the cells.

The jurors were deadlocked on the third count.

Masterson, star of That 70s Show, could get 30 years in prison when he is sentenced. The judge on Wednesday ordered he be held in jail until that hearing.

A group of about 10 Scientology friends and family – including actor Billy Baldwin, who is married to Bijou’s half-sister, singer Chynna Phillips – watched in shock as he was led away to the cells.

Scientology was front and center during both criminal trials.

All three women testified that the reason they took so long to report him to the police was their fear of retribution from the Church of Scientology. They are also suing the actor and the Church of Scientology in civil court, claiming that they’ve been harassed and intimidated since reporting him to police.

A jury found Danny Masterson guilty on two of three rape counts on Wednesday. He’s seen entering court Wednesday with wife Bijou Phillips

His wife, actress Bijou Phillips – who had been at his side throughout the four-week trial at criminal court in downtown Los Angeles – burst out in tears as the jury of seven women and eight men gave their verdicts.

She was asked by Judge Charlaine Olmedo to ‘maintain her composure’ or go outside.

The judge ordered Masterson – who had been free on $3.3 million bail since his arrest three years ago – to be taken into custody, and scheduled a hearing for August 4, where his attorneys will argue for bail to be reinstated.

Immediately after Judge Olmedo announced she was remanding the actor, a sheriff’s bailiff pulled his arms behind his back and handcuffed him.

The actor – wearing a dark blue suit and white, open-neck shirt – faces up to 30 years in prison on the rape convictions: 15 for each one.

He will also have to register as a sex offender.

The verdicts on Wednesday came on the eighth day of jury deliberations. Jurors found him guilty of raping victims Jane Doe One and Jane Doe Two.

On the third charge of raping Jane Doe Three, the jury was ‘hopelessly deadlocked’ at eight in favor of guilty and four in favor of not guilty.

Masterson’s attorney, Philip Cohen, argued that his client should be allowed to remain on bail, wearing an electronic monitor and being kept on 24-hour house arrest.

But Judge Olmedo rejected his plea saying Masterson’s offenses were ‘serious and violent felonies’ and called him a ‘potential flight risk.’

Reinhold Mueller, the deputy district attorney, told the court that he agreed with Judge Olmedo’s decision to revoke Masterson’s bail, echoing her comment and saying: ‘These were serious and violent offenses.’

On the charge of raping Jane Doe 3 – which jurors remained hung on – the judge asked ‘if there is any reasonable possibility of arriving at a verdict.’

The female jury foreperson answered ‘No,’ adding that the panel voted five times without being able to come up with a unanimous decision.

Los Angeles County District Attorney George Gascón said in a statement after the verdict: ‘In April 2003, Masterson raped a 28-year-old woman and sometime between October and December of that year he sexually assaulted a 23-year-old woman who he had invited to his Hollywood Hills home.

‘We want to express our gratitude to the three women who came forward and bravely shared their experiences. Their courage and strength have been an inspiration to us all.

‘While we are disappointed that the jury did not convict on all counts, we respect their decision. The verdicts handed down by the jury in this case were undoubtedly a difficult one to reach and we thank the jurors for their service.’

Masterson – who played smart-mouthed Steven Hyde on That ’70s Show – was accused of raping the three women at his Hollywood Hills home between 2001 and 2003.

He pleaded not guilty to all the charges and he was looking at a sentence of 45 years to life in prison if he had been convicted on all three.

His accusers, who DailyMail.com is identifying only as Jane Does 1 through 3 – are all former Scientologists. In their civil case they claim that they’ve been harassed and intimidated since reporting him to police.

A status hearing on that case is scheduled for June 28.

They said that church officials warned them not to use the word rape; that turning in a fellow Scientologist to law enforcement was considered a ‘high crime’; and if they disobeyed that doctrine, they could be declared a ‘suppressive person’ – cast out by the church and left alone, cut off from family and friends.

In the second trial, prosecutors put much more emphasis than they did in the first on their claims that Masterson drugged his alleged victims by spiking drinks he gave them before raping them.

Calling Masterson a ‘predator’, Deputy District Attorney Ariel Anson said in her closing argument: ‘It all starts with a drink. This is his playbook.

‘The defendant drugged his victims to be in control. When he drugs them, he is completely able to control them. And he does it over and over again.’

Her prosecuting partner, Mueller, added – as he pointed at Masterson – ‘After they were drugged, they were raped by this man over here.

‘It’s beyond reasonable doubt that this man drugged these women and raped them. It’s time to hold Mr Masterson accountable for what he’s done.’

Masterson’s lawyer, Philip Cohen, objected Wednesday to the prosecution’s frequent referrals to his client drugging his alleged victims before raping them and called for a mistrial, saying, ‘drugging does not constitute forcible rape.’

But Judge Olmedo denied his mistrial motion, telling him that when considering drugging and use of force in a rape case, ‘one does not necessarily preclude the other.’

Cohen, pointed out that there are no toxicology reports to back up the 20-year-old drugging allegations against his client – who has always maintained that the sex with the three Jane Does was ‘consensual.’

Another difference between the two trials was the addition in the second of testimony from another ‘victim’ – a woman who claimed Masterson raped her in Toronto in 2000, though he was never charged with the alleged assault.

Prosecutors added her to the witness list to establish a pattern of ‘prior bad acts’ by Masterson.

But Cohen dismissed the move, saying the new accuser was brought in for the retrial to ‘save the case’ for the DA.

Of the three women whose rape Masterson was charged with, Jane Doe 1 had told the court in the first trial that in April 2003 she was at the actor’s house where he gave her a fruity red drink with vodka that made her feel woozy.

She said he then threw her in his Jacuzzi and carried her upstairs where she passed out, and woke up to find him raping her

She fought back, pushed a pillow into his face, she told the jury.

But he pushed it back into her face, smothering her and she blacked out again.

When she woke, she said, Masterson opened a bedside drawer and pulled out a gun which he brandished, telling her: ‘Don’t f**king move.’

Jane Doe 3 – who lived with Masterson for six years – was only 17 when she met him and he persuaded her to become a Scientologist, the court heard.

About a year into their relationship he became very controlling and very aggressive sexually. She said she would often wake up at night and he would be on top of her, having sex with her.

In one such incident in November 2001, when she woke up to find him having sex with her, she told him no and tried to push him off, the court heard.

When that didn’t work, she pulled his hair. But he retaliated by hitting her across the face and calling her ‘white trash,’ said prosecutors.

Scientology was front and center during both criminal trials. All three women testified that the reason they took so long to report him to the police was their fear of retribution from the Church of Scientology

Jane Doe 2 met Masterson at a bar in 2003 and gave him her phone number.

He called her and invited her to his home. She went, and, the court heard, after having a drink and a stint in his Jacuzzi, she found herself in his bathroom shower with him where he ‘suddenly shoved his penis into her vagina.

‘She said no, I told you no sex.’

They ended up in Masterson’s bed where, despite her protests, he flipped her over and started pounding her from behind ‘like a jackhammer,’ she testified, adding that she felt ‘like a limp rag doll.’

Masterson’s attorney, Cohen, challenged ‘inconsistencies’ in the women’s testimony and statements to police, accusing them of ‘blatant fabrications.’

And he asserted that the three had ‘colluded,’ choreographing and ‘tweaking’ their rape stories to help get Masterson convicted – which in turn could help them win a big cash payout in the civil lawsuit they have brought against him and the Church of Scientology.

Before the judge turned the case over to the jury just before 10am on May 17, Mueller countered Cohen’s ‘inconsistencies’ argument, telling jurors: ‘Don’t be fooled – he (Cohen) is trying to get you to think there is a grand conspiracy.

‘Each of these victims spoke individually about what happened to them before they spoke to each other. So how is that a conspiracy?

‘There is no conspiracy. There was no tweaking. He’s guilty.

‘It’s not reasonable to believe any of these victims were lying.’
